Background- During the June 11, 2008 TAP meeting, a discussion of an amendment to add “Appendix X2” references to the current Plan, submitted by Tulalip, was discussed by the Eligible Tribes. The amendment also proposed changes to the Uniform Terminal Allocation Transfer Agreement which would: 1) incorporate all appendices, current and future; 2) clarify language in the dispute resolution section, and 3) amend the arbitration clause. The motion failed for lack of a majority. 

Mr. Stebbins, the Plan Coordinator, said that he would poll the tribes to schedule a work session in which specific language addressing the Appendix X2 issue could be vetted by the tribes’ legal counsel, in order for an amendment to be presented at a special meeting to be called at a future date. That meeting was held on June 23, 2008. As a result of that meeting, new language (attached), which has been circulated to and vetted by the tribal attorneys group, has been proposed by Tulalip, to amend the Plan.
